法治视角下狱政管理精细化的问题及改进研究

Research on the Refinement of Prison Administration and Improvement from the Perspective of Rule of Law

狱政管理工作的法治化水平制约着监狱工作的法治化水平。近年来,虽然狱政管理精细化建设为狱政管理的法治化建设提供了基础保障,但同时精细化的过度与失衡又制约了狱政管理的法治化建设进程与质量,甚至偏离了法治化建设目标。在法治视角下的狱政管理精细化建设,必须突破单一或过度精细化的困局,回归理性,以法治化主导狱政管理活动的取舍,以精细化确保具有法治价值的创新性狱政管理活动得以有效实施。运用法治思维和法治方式对狱政管理精细化进行调适,可以有效实现狱政管理的法治化要求和目标。

The level of legalization in prison administration restricts the level of legalization in prison work.In recent years,although the refinement construction of prison administration has provided basic guarantee for the rule of law construction of prison administration,the excessive and unbalanced refinement construction has also restricted the process and quality of the rule of law construction of prison administration,and even deviated from the goal of the rule of law construction.From the perspective of the rule of law,the refinement construction of prison administration must break through the dilemma of being single or overly refined,return to rationality.The rule of law dominates the selection of prison administration activities,and ensures the effective implementation of innovative prison administration activities with the value of rule of law.The application of rule of law thinking and methods to adjust the refinement of prison administration can effectively achieve the requirements and goals of the rule of law in prison management.
