监狱计分考核制度的时空阻隔式改革——基于减刑、假释程序视角

Spatiotemporal Barrier Reform of Point System in Prison——From the Perspective of Procudures for Sentence Reduction and Release on Parole

服刑人员作为追求自身利益最大化的理性主体,积极参与计分考核制度以获得减刑、假释为终极目的,这是因为计分考核结果是减刑、假释程序流转中最重要的证据材料。因此,规范减刑、假释程序首先应当保证计分考核结果的真实性,但不能只从担当最后一道防线的审理程序入手,而应当在根源上对计分考核制度本身进行完善,使其更加科学合理。时空阻隔式改革可以实现监狱警察与服刑人员的空间隔离和监狱警察、服刑人员与计分考核结果的时间隔离,辅之检察机关的检察监督,可以有效保证减刑、假释程序中流通的证据材料的真实性,防范司法腐败。

Prison convicts,the rational subjects to pursue the utmost of their own interests,would participate actively in the point assessment system so as to fulfill their ultimate goal of sentence reduction or release on parole,since the scoring results tend to be the most important evidence in the approval procedures.Therefore,to standardize the procedures of sentence reduction and release on parole,it is essential,first of all,to ensure the authenticity of the scoring results.However,we should not treat the point system only as the last line of defense in the approval procedures.Instead,we should fundamentally reform the system to make it more scientific and reasonable.The reform of spatiotemporal barrier can achieve both the spatial isolation between correctional officers and prison convicts,and the temporal separation between them and the scoring results.The pro curatorial supervision from the procuratorate authorities can help to effectively make sure the authenticity of the evidence materials for sentence reduction or release on parole and prevent judicial corruption.
