摘要
消费者购车后无法拿到汽车合格证,导致车辆无法上牌的纠纷,是汽车消费类投诉的热点和难点,不少案件最后不得不诉诸于司法程序。从促进汽车消费市场健康有序地发展,保障消费者合法权益的角度出发,提出了三方面的解决思路:一是消费者选择侵权之诉优于违约之诉;二是金融机构严格依据《民法典》规定以汽车本身来设立抵押担保;三是政府职能部门完善相关监管措施。
The disputes that a consumer cannot obtain the vehicle certificate after purchasing an automobile and so fail to have it licensed tend to be a tough and hot issue in automobile consumer complaints,and many of them have to be resolved by means of judicial procedures.To ensure a healthy and orderly development of the automobile consumption and protect the legitimate rights and interests of consumers,we put forward the solutions in the following three aspects:the consumers shall file lawsuits of tort rather than breach of contract;the financial institutes shall strictly follow the Civil Code to set up the mortgage with the vehicle involved as the guarantee;the functional departments of the government shall improve their measures of supervision and regulation.
