完善保外就医制度的思考

保外就医制度是我国施行已久的一项制度,体现了对生命权的尊重,是一种制度关怀。然而,保外就医制度的实施现状存在诸多的问题。保外就医制度的完善,需要对保外就医的决定权、监督权、鉴定权和监管权进行明确规制,需要重新修改和构建保外就医审批制度、保外就医鉴定制度、保外就医管理制度和保外就医续保制度,以回应时代发展的需要。

Medical parole has been a long-established mechanism in our country,which is a kind of institutional care exhibiting the respect for right to life.However,there are many problems during the implementation of the mechanism at present.The consummation of the medical parole mechanism calls for definite regulations over the powers of decision-making,supervision,appraisal,and administration.To keep abreast with the needs of the times,it is necessary to revise and renovate the medical parole mechanism in terms of approval institution,appraisal mechanism,administration system,and insurance renewal framework.
