关于《监狱法》修改的主要条款建议

On Major Provisions to be Revised in Prison Law

随着监狱改革的深入推进,现行《监狱法》的某些条款已经与监狱发展极不适应,有必要对《监狱法》进行进一步的修订和完善。《监狱法》修改应当明确刑罚惩罚的地位;明确规定"促进罪犯融入社会"的内容;将第三章章名修改为"刑罚执行的程序";在第四章中规定"开放监狱,增加学习释放与劳动释放"的内容;将"危险控制措施的内容"写进法律条款。

With the in-depth advancement of prison reform,certain provisions in the prevailing Prison Law can no longer keep abreast with the development of prisons,making it imperative to further revise and improve the Law.The revision of Prison Law should make clear the position of criminal penalty,stipulate the item of"facilitating the reintegration of criminal offenders into society",rename Chapter Three as"Procedures for Penalty Execution",provide in Chapter Four the opening of prisons as well as the provisions of release-on-study and release-on-labor,and involve the risk control measures in legal provisions.
