On Prosecutors’ Professional Ethics

检察官职业伦理的内容是:检察官执业素养提升和职业伦理的遵循是检察官履职内在要求和社会期盼。检察官具备的职业伦理是对其法定职责、职业操守最基本的要求和底线约束,体现在职业道德的具体要求上,我国对检察官职业伦理道德方面总结提炼为忠诚、为民、担当、公正、廉洁五项内容,既借鉴了西方国家司法经验,又体现了中国特色社会主义法治的本质。加强检察官职业伦理建设,必须通过定期法律教育和职业培训、提供良好物质保障、发挥检察主导作用、定期进行职业道德评估、实行奖惩机制等途径,促使检察官遵守职业伦理、执业纪律,依法履责,维护社会公平正义。

Prosecutors’professional ethics refers to the improvement of their professionalism and compliance of the professional ethics during the performance of their duties,which are both the inherent requirements of the career and the social expectations of the general public.The professional ethics possessed by prosecutors are the most basic requirements and bottom-line constraints for their statutory duties and discretion,as indicated in the concrete requirements of their professional ethics.The professional ethics for the prosecutors in China are summarized as loyalty,people-oriented,responsibility,justice and integrity,which not only draw on the judicial experience of Western countries,but also reflect the essence of the socialist rule of law with Chinese characteristics.The prosecutors’professional ethics can be reinforced through measures like conducting legal education and training regularly,offering excellent material guarantees,giving play to the leading role of prosecution,performing assessment on a regular basis,and practicing rewards and punishment mechanism,so as to encourage the prosecutors to abide by the professional ethics and disciplines,perform their duties in accordance with law,and help to maintain social fairness and justice.
