摘要
作为我国版权保护体系的重要组成部分,对版权犯罪的刑法规制在维护版权市场稳定、保护版权人权利等方面发挥着不可替代的作用。当前,宽严相济是我国的基本刑事政策,其必然对规制版权犯罪的立法和司法活动产生重要影响。应完善版权刑事立法保护,加强版权刑事司法保护,结合我国版权发展和保护实际,探索在规制版权犯罪中贯彻宽严相济刑事政策的路径,进而提升我国版权保护水平。
As an important part of copyright protection system in our country,the criminal regulations against copyright crimes have played an irreplaceable role in maintaining the stability of the copyright market and protecting the rights of copyright owners.At present,tempering justice with mercy is one of the basic criminal policies in our country,which certainly has an important impact upon the legislation and judicial activities against copyright crimes.To further improve the copyright protection,it is necessary to strengthen legislation and criminal justice,and to explore ways to implement the criminal policy of tempering justice with mercy during the regulations against copyright crimes to keep abreast with the practice of copyright development and protection in our country.
