刑法教义学中的体系解释

体系解释作为一种解释方法,是随着从概念法学到利益法学的演变而变化的,它对于补充语义解释的不足具有重要意义。体系解释建立在体系思维的基础之上,其将刑法条文置于整个法律体系之中,由此获得对刑法文本的正确理解。在刑法教义学中,体系解释可以分为外在体系解释和内在体系解释。其中,外在体系解释采用“形式—逻辑”的分析方法,主要解决不同法律和同一法律之间的协调问题,从而为法律的整体性适用提供法理根据。内在体系解释则采用价值分析方法,追溯法律规范的意义脉络,为理解法律含义提供共同的价值标准。
