浅析我国环境影响评价公众参与的完善路径

A Brief Analysis on the Improvement Path of Public Participation in Environmental Impact Assessment in China

生态环境部公布新版《环境影响评价公众参与办法》,该办法明确了建设单位的主体责任,完善了信息公开和公众参与程序,健全了公众参与的保障机制。然而当前我国公众参与还存在参与对象缺乏广泛性和代表性,参与形式单一、被动参与,对公众意见重视程度不足以及责任追究机制不健全等问题。应当借鉴国外立法经验,增强参与的主动性,扩大参与范围,健全保障机制,探索更为有效的公众参与模式。

The Ministry of Ecology and Environment has released a new version of The Public Participation Method for Environmental Impact Assessment,The measures clarify the main responsibilities of construction units,improve the procedures for information disclosure and public participation,and improve the guarantee mechanism for public participation.However,there are still some problems in China’s public participation,such as the lack of universality and representative of the participants,the single form of participation,the passive participation,the insufficient attention to public opinions and the imperfect accountability mechanism.We should learn from the experience of foreign legislation,enhance the initiative of participation,expand the scope of participation,improve the guarantee mechanism,and explore a more effective mode of public participation.
