项目面向的一体化工程行政合规制度建构

行政合规制度是合作治理理念的具体运用,能够化解行政监管需求和行政资源供给之间的矛盾。我国工程建设领域业已完成了行政合规制度的引入,但是囿于单一行为主体架构和工程多元主体交互特征的冲突,制度实践遭遇到主体关系交错重叠、规制措施繁复悬置、责任机制逻辑混乱的困境。对此,应当将工程行政合规制度从企业面向转变为项目面向,通过项目一体化改造实现对工程行政合规制度的合作理性注入,并以监理单位为建构中心,从规则制定、守法监督、执行反馈三个方面完成对一体化工程行政合规制度的构建。

Administrative compliance system is the specific application of the concept of cooperative governance,which can resolve the contradiction between the demand of administrative supervision and the supply of administrative resources.China’s engineering construction field has already completed the introduction of the administrative compliance system.However,due to theconflict between the structure of a single actor and the interaction characteristics of multiple agents,the practice of the system isconfronted with the problems of overlapping of the relationship between the agents,complicated and complicated regulatory measures,and logical confusion of the responsibility mechanism.In this regard,we should transform the engineering administrativecompliance system from the enterprise oriented to the project oriented,realize the rational injection of the engineering administrative compliance system through the project integrated transformation,and take the supervision unit as the construction core,complete the construction of the project integrated engineering administrative compliance system from three aspects of rule-making,law-abiding supervision and implementation feedback.
