社区矫正实施主体机制的二元建构——以社区矫正法治化建设为基点

The Dual Construction of Community Correction Implementing Subject Mechanism——Based on the Construction of the Rule of Law of Community Correction

《社区矫正法》《社区矫正法实施办法》规定了社区矫正中政府和社会力量的二元实施主体,这是社区矫正工作的制度基础之一。目前,社区矫正工作存在政府权力过大、赋权落地效果不佳等问题,一些地方政府只是将社会力量作为“工具性组织角色”而“选择性赋权”,致使政府与社会力量的协作融合出现了“有形无神”“形神分离”的现象。因此,需要建构政府与社会力量在教育帮扶工作中均衡、对等和融合的共商协作机制,将社区矫正工作重心由监督管理的“技术控制”转向具有人文特质的矫正教育,并将社会力量的赋权实质化,使教育帮扶真正在平衡、平等和运行有效的共商协作机制下运行。

"The Community Correction Law"and"the Measures for the Implementation of the Community Correction Law"stipulate the dual implementation subjects of government and social forces in community correction,which is one of the institutional foundations of community correction work.At present,there are problems in the government's"excessive power"and"ineffective implementation of empowerment"in community correction work.Some local governments only regard social forces as"instrumental organizational roles"and"selective empowerment",resulting in the government and social forces the phenomenon of"tangible form without spirit"and"separation of form and spirit"appeared in the collaborative integration of the company.Therefore,it is necessary to build a balanced,reciprocal and integrated consultation and cooperation mechanism between the government and social forces in the education assistance work,shift the focus of community correction work from"technical control"of supervision and management to correction education with humanistic characteristics,and substantiate the empowerment of social forces,so that education assistance can truly operate under a balanced,equal and effective consultation and cooperation mechanism.
