回归法学本位的环境法学研究(1979~2020年)——基于8960篇核心期刊文献计量分析

Environmental Law:The Way to Jurisprudence Orientation(1979-2020)——Based on bibliometric analysis of 8960 papers from CSSCI

本文以1979年至2020年核心期刊收录的环境法学论文为样本,通过文献阅读以及利用引文空间(Citespace)可视化工具进行量化分析,归纳了环境法学萌芽至今的学术成果、学术热点、学科研究范式以及学者群体的变化趋势。研究发现:(1)我国环境法学学科研产出正稳步增长;论文早期集中见刊于法学类期刊,当下主要见刊于综合社科类期刊。(2)在研究范式上,环境法学从未形成成熟的方法论,其自觉发展到社科法学与法教义学平分秋色,研究风格从倾向比较借鉴发展到更加重视本土资源。(3)环境法学研究重心受立法修法、政策颁布以及环境热点事件影响较大。(4)在研究者群体上,环境法学者年龄层次逐渐丰富,陆续有主流部门法学者关注环境法学研究;研究力量早期集中在武汉市和北京市,现已辐射至全国各地。仍需指出的是,当下近七成环境法学论文刊发在资环类期刊与综合社科类期刊上,环境法学论文在主流法学期刊上的曝光度与其他部门法相比仍较弱,这间接导致了环境法学环境科学属性与对策法学属性的增长。如今环境法学回归法学本位,不仅需要环境法学者的辛勤耕耘,更关键的是还需要得到主流法学部门和期刊的重视与支持。

This paper summarizes the changing trends of academic achievements,academic hotspots,disciplinary research paradigms and scholars'groups in environmental law from its emergence to the present through literature reading and quantitative analysis using Citespace visualization tool,taking environmental law papers collected in CSSCI from 1979 to 2020 as samples.The study found that:(1)the research output of environmental law in China is growing steadily;the papers are mainly published in law journals in the early stage,but mainly in comprehensive social science joumals at present;(2)in terms of research paradigm,environmental law has developed from immature methodological self-consciousness to equal division between social science of law and legal dogmatics,and the research style has developed from the tendency of comparative borrowing to more emphasis on local resources;(3)the focus of environmental law research is influenced by legislative amendments,policy promulgations and environmental hotspots;(4)in terms of researcher groups,environmental law scholars are gradually enriched in age level,and there are mainstream sectoral law scholars focusing on environmental jurisprudence research;the research force was concentrated in Wuhan and Beijing in the early days,but now it has radiated to all over the country.It should be noted that nearly 70%of environmental law papers are published in environmental journals and comprehensive social science journals,and the exposure of environmental law papers in mainstream law journals is weaker than that of other branches of law,which has indirectly led to the growth of environmental science atributes and response jurisprudence attributes of environmental law.Nowadays,the return of environmental law to the jurisprudence requires not only the hard work of environmental law scholars,but also,and more crucially,the attention and support of mainstream law departments and jourmals.
