摘要
作为法院之外的合同纠纷和其他财产权益纠纷的重要解决机构,仲裁机构的去行政化并回归独立性是其本质属性的要求,也是我国仲裁的未来发展趋势。基于自主构建的仲裁机构独立性指数模型,对我国203个仲裁机构进行测度,结果显示我国仲裁机构的整体独立性水平较低。欲实现仲裁机构的独立性,应明确仲裁机构的独立法人地位,仲裁机构应完全独立于行政机关及其职能部门,不应成为事业单位或其二级机构,赋予仲裁委员会在人事管理、财产管理、机构设置等方面的自主权,减少甚至去除仲裁委员会主任官方背景,淡化仲裁机构秘书处人员的行政化色彩。
The arbitration institution is a settlement institution for contract disputes and other property rights disputes stipulated by the laws of our country.De-administration and return to independence are its future trends.By constructing the independence index model of arbitration institutions,we measured 203 arbitration institutions in my country,and the results showed that the overall independence of arbitration institutions in my country is relatively low.In order to realize the independence of arbitration institutions,the independent legal status of arbitration institutions should be clarified,and they should be completely independent of administrative agencies and their functional departments,and should not become public institutions or their secondary institutions.The establishment of their autonomy contains following aspects such as the reduction or even elimination of the official background of the director of the arbitration commission,which will dilute the administrative color of the secretariat staff of the arbitration institution.
