Normative Analysis of the Mode of Legislative Participation in China——Analyzing the Relevant Provisions of the Legislation Law

对我国《立法法》中规定的立法参与内容进行规范分析并将其模式化,可以有效指导和引导立法参与研究与实践。"参与情境""决策主体""参与主体""参与形式""效力"这5个元素,构成了立法参与模式的基本内容。依据立法程序的不同类型可以将立法参与模式划分为人大立法参与模式与行政立法参与模式;并且,还可以依据不同的立法阶段对它们分别进行细分。依据立法参与的强度不同,可以将立法参与模式划分为强参与模式与弱参与模式。依据参与主体类型的不同,还可以将立法参与模式划分为专家参与模式与大众参与模式。

We should analyze and stereotype the content of legislative participation in the Legislative Law.Only do it,can we effectively guide the practice and research of legislation participate.The five elements—"participation situation","decision-maker","participation subject","participation form"and"effectiveness"constitute the basic content of the mode of legislative participation.According to different types of legislative procedure,the legislative participation mode can be divided into the NPC’s legislative participation pattern and the administrative legislative participation pattern;and according to the different stages of the legislation,it also can be further subdivided.According to the intensity of legislative participation,the legislative participation model can be divided into two types:strong participation model and weak participation model.In addition,according to the different types of participants,the legislative participation model can be divided into two categories:expert participation mode and public participation model.
