宪法的固有含义指特定政治共同体的构成状态或规则与原则。随着人类社会的不断发展,特定政治共同体的构成不断变迁,宪法的概念也不断变化。近代意义的宪法以近代自然法理论为基础,法治与民主是其基本原则。西方现代意义的宪法是近代意义宪法在现代社会的变种,是对其局限性的克服。试图在根本上对西方近代意义宪法局限性予以克服的是社会主义宪法。中国现行宪法应该属于现代意义的社会主义宪法。

The innate signification of the word"constitution"is the state or the rule and principle which constitute the given political community.Along with the development of human society,the frame and constitution of the given political community has changed,which makes the concept of the constitution change.The modern theory of natural law provides a foundation for the modern constitution which consists of the two principles,including the rule of law and democracy.The modern constitution in thepresent Western society is the variation of the contemporary constitution,and it overcomes the weaknesses of the contemporary constitution.But in attempt to overcome its essential weaknesses,the socialist constitution is made.
