理性的神话:纯粹法学的现代性症状

The Myth of Reason:The Symptom of Modernity in the Pure Theory of Law

凯尔森的纯粹法理论在法学领域彰显崇奉理性的"现代性症状"。一方面,规范命题承载着人类理性自治的愿景,分离命题摒弃以超验价值证成世俗政治的尝试,基础规范更是赋予人类自身理性以神明地位,对国家—法律二元论的祛魅也昭示着人类理性的勃勃雄心;另一方面,由于人类始终是有限的理性存在,"理性的神话"便总有其缺陷,纯粹法理论也不可能做到完全的"纯粹",彻底凌驾于实然的应然权威是可疑的,道德生活的"诸神之争"腐蚀着共同体的根本,封印主权者的企图也意味着对例外状态拙于应对。着眼于现代性视角,对纯粹法理论的认识将更生动、丰满和深刻。

Kelsen’s pure theory of law obviously reflects the symptom of modernity as reason worship in the field of jurisprudence.On the one hand,the normativity thesis mirrors human’s rational autonomy,the separation thesis discards transcendent value to justify secular politics,the basic norm endows human’s reason with the role of God,and the critique on state-law dualism also shows the ambition of human’s reason.But on the other hand,because human are limited rational existence,the "myth of reason" has defects,and pure theory of law cannot be completely "pure ".The authority of " ought" which surpasses "is" is dubious,the pluralism of moral life erodes the foundation of community,and the attempt to seal the sovereign means inability when confronted with the state of exception.From the perspective of modernity,we can have a more vivid,deeper and all-round understanding of pure theory of law.
