人类命运共同体理念指导下的《海洋环境保护法》修改

Amendments to Marine Environment Protection Law Guided by the Concept of Community of Shared Future for Mankind

海洋环境人类命运共同体是人类命运共同体的一个具体类型。为推动海洋环境人类命运共同体构建,《海洋环境保护法》应当确定国际合作原则,给推动构建人类命运共同体的国家意志以立法表达。海洋环境国际合作空间巨大,可选择的形式多样,国务院及其相关职能部门可以也有责任选择与相关国家共同构建海洋环境人类命运共同体的适宜合作形式。国务院相关职能部门与外国签订海洋环境保护国际合作法律文件应当遵守《海洋环境保护法》。国务院相关职能部门负责单项海洋环境保护国际合作,生态环境主管部门"统管"海洋环境保护国际合作,负责处理与相关国家在海洋环境保护领域的全面合作。

The Community of Shared Future for the Marine Environment is a specific type of the Community of Shared Future for Mankind.In order to promote the construction of the Community of Shared Future for Marine Environment,the Marine Environmental Protection Law should establish the principle of international cooperation and give legislative expression to the national will for constructing the Community of Shared Future for Mankind.The space for international cooperation on the Marine environment is huge and there are various forms to choose.The State Council and its relevant functional departments can and should choose the appropriate forms of cooperation to jointly build a community with a Shared Future for Mankind on the marine environment with relevant countries.The relevant functional departments of the State Council are responsible for individual international cooperation in marine environmental protection,while the competent ecological and environmental departments are responsible for"overseeing"international cooperation in marine environmental protection and for handling comprehensive cooperation with relevant countries in the field of marine environmental protection.
