欧盟版权规则的现代化:目标、实现路径与启示

为应对数字与网络技术对内容生产、传播与获取的挑战,欧盟提出版权规则的现代化动议,其目标在于为跨越国界利用作品创造更多的获取方式,创建具有良好运行的版权市场,以及为教育、研究与文化传承等活动提供更多使用版权材料的机会,这些目标实现的路径主要包括延伸性集体管理、为特定主体创建新的权利、适当增加网络服务提供商的义务和创建新的版权限制与例外制度,以及为作品利用创建更好的信息透明与谈判机制。欧盟版权规则现代化的启示在于,应该重新考虑正在修订的我国《著作权法》所对应的相关问题。

In order to respond the challenge to the production,communication and accession from the technology of digital and network,the EU has put forward the motions of modernization of European copyright rules.Its aims are to create more ways for accessing the utilizing works crossing the borders,create the good function market,and create more utilizing opportunities of materials of the copyrighted works in the activities of the education,research and cultural inheritance.The implementation paths of such aims include extended collective management,creating new systems of exception and limitation of copyrights and creating better mechanisms of information transparency and negotiation.The enlightenment of the modernization of European copyright rules is that the corresponding issues should reconsidered in the revision of China’s Copyright Act.
