摘要
商标制度存在颇多难解之"结"。各种疑惑和截然不同的声音,根源于对商标保护基础认识不清。本文致力于梳理并简化商标保护的合理性基础,对注册商标、未注册商标、注册与使用的关系等建立清晰、准确的认知。
There are plenty of issues and different opinions existing in trademark system.The essential reason for that is the confusion of the rational basis of trademark protection.The purpose of this paper is to clarify and simplify the rational basis of trademark protection,hoping to help understanding the whole system of trademark protection.
