论人工智能对法官勤勉义务的延展

On the Extension of Artificial Intelligence to the Duty of Diligence of Judge

人工智能在司法中的运用减轻了法官的工作量,但并没有减轻法官的勤勉义务,工作量的减轻与勤勉义务的减轻并非等同。法官勤勉义务深层内涵要求法官亲历审判,不被信息壁垒、信息舆论所限制,并在把握时代脉搏的基础上,通过个案促进社会公正的实现,进而做出具有引领性和超越性的裁判。但是,人工智能在司法中的运用却存在削弱亲历性、削弱裁判的引领性和超越性的倾向。在克服这种倾向的过程中,法官勤勉义务获得了延展,要求法官加强裁判的勇气,增加裁判的敏锐度,从而及时地实现公正。

The application of artificial intelligence in judicature reduces the workload of judges but does not reduce the duty of diligence of judge.The reduction of workload is not equal to the reduction of duty of diligence.The deep connotation of the duty of diligence of judge requires the judge to personally experience the trial neither limited by information barriers nor information public opinion,and make a leading and transcendental judgment,on the basis of grasping the pulse of the times,in order to realize the social justice through individual cases.However,the application of artificial intelligence in justice has the tension of weakening the personal experience and the guidance and transcendence of the judgements.In the process of overcoming this tension,the duty of diligence of judge has been extended,which requires the judge to strengthen the courage of the judge and increase the sensitivity of the judge,so as to realize justice in time.
