传统政治文化语境下当代农村基层调解多重性叠加与联动之治

Multiple Superposition and Linkage of Contemporary Rural Grassroots Mediation in the Context of Traditional Political Culture

构建农村基层调解力量联动工作机制,是新时代中国特色社会主义法治建设的客观要求,从传统政治文化来看,这一工作仍然面临许多挑战,如从传统延伸过来的基层法治的二元权威与治理价值、基层群众法治主体意识缺失、“超职权主义”的司法与行政者思维等,新时代农村基层调解力量联动工作体系至少应在体系权威、体系价值、体系程序三个方面体现出与传统乡村治理体系完全不同的一套运行特点,整合基层各调解力量的价值目标,优化职权主义下的现代民主法治思维,并逐步构建起农村基层调解的中国话语权体系。

Establishing a working mechanism for the linkage of rural grassroots mediation forces is an objective requirement for the construction of a socialist rule of law with Chinese characteristics in the new era.From the perspective of traditional political culture,this work still faces many challenges,such as the duality of the grassroots rule of law extending from the traditional value of authority and governance,the lack of the rule of law subject awareness of the grassroots and the thinking of the“super-authoritarian”judiciary and administrators,etc.In the new era,the rural grassroots mediation force linkage work system should reflect at least three aspects:system authority,system value,and system procedures to make it completely different set of operating characteristics from the traditional rural governance system,integrating the value goals of various mediation forces at the grassroots level,optimizing modern democratic rule of law thinking under authoritarianism,and gradually building a Chinese discourse power system for rural grassroots mediation.
