内蒙古基层法院司法改革现状及探索

The Dilemma of Judicial Reform and the Path Choice of Solving Difficulties of Grass-roots Courts in Inner Mongolia

内蒙古基层法院推进司法改革过程中出现的问题,对司法改革的成效产生了重要影响,例如:立案登记制改革后,"案多人少"矛盾与法官职业素养提升的冲突;员额制改革后,基层法官职业保障受限、发展空间有限的问题;财物统管改革后,统管模式的科学性问题;内设机构和人事制度改革后,"去行政化"的边界问题。基层的这些问题直接影响到司法权威的重塑和改革措施的可持续性,现有的改革措施也没能与基层的现实司法需求相契合,导致基层司法的运行出现了"高负荷运转"与"低获得感"交织的现状。

In the process of Inner Mongolia promoting judicial reform in grass-roots courts,which has greatly affected the effectiveness of the reform.For example:after the reform of case registration system,the contradiction between the situation of"more cases and fewer judges"and the improvement of judges’professional accomplishment appears;after the quota system reform,the profession safeguard of the grass-roots judge is restricted,the development space is limited;After the reform of property’s unified management,the scientific problem of the unified management mode is prominent;after the reform of internal organization and personnel system,the boundary problem of"de-administration"is discussed.These problems at the grass-roots level directly affect the reshaping of judicial authority and the sustainability of reform measures,and the existing reform measures are not in line with the actual judicial needs at the grass-roots level.As a result,the operation of grass-roots justice appears an interwinding status of"high load operation"and"low sense of acquisition".
