个人破产缺位导致我国的破产制度是不完整的,总结过去十几年企业破产制度发展经验,管理人在破产程序中的重要作用已经得到充分认识。要充分发挥管理人在个人破产程序中的作用,需要对个人破产程序中的管理人进行合理的制度设计。综合考量我国破产司法实践,破产管理人法律地位和具体设置,个人破产执业可行性、官方破产管理人等问题,需要法律规则给出符合现阶段我国个人破产制度运行的设计方案。

The omission of personal bankruptcy has led to the incompleteness of China’s bankruptcy system.Summarizing the development experience of enterprise bankruptcy system in the past over ten years,the important role of administrators in bankruptcy proceedings has been fully recognized.A full play to the role of administrators in the personal bankruptcy proceedings needs a reasonable system design for administrators in the personal bankruptcy proceedings.After comprehensively considering China’s bankruptcy judicial practice,the legal status and specific setup of bankruptcy administrators,the feasibility of personal bankruptcy practice,official bankruptcy administrators and other issues,it is necessary for lawmakers to provide a design scheme in line with the operation of China’s personal bankruptcy system at the current stage.
