The Principle of Ecological Rule of Law under the Guidance of Xi Jinping’s Theory on the Rule of Law in Ecological Civilization

习近平法治思想的生态文明法治理论(以下简称习近平生态文明法治理论)是新时代生态文明法治建设的科学指南。生态法治原则的建构应符合习近平生态文明法治理论的内在要求。生态法治原则包括基于生态法治伦理观的生态优先原则、基于生态法治安全观的风险预防原则和基于生态法治整体观的综合治理原则。科学而完整的生态法治原则体系,有利于实现法治形式层面的法律之治和实质层面的良法善治,以法治保障生态文明建设,推动中国特色社会主义法治体系的健全与完善。

Xi Jinping thought of rule of law in ecological civilization(hereinafter referred to as Xi Jinping’s theory on the rule of law in ecological civilization)provides scientific guidance on the construction of ecological rule of law in the new era.The principle of ecological rule of law should be based on the inherent requirements of Xi Jinping’s theory on the rule of law in ecological civilization,including ecological priority principle based on ethics of ecological rule of law,risk prevention principle based on security of ecological rule of law and comprehensive management principle based on holistic view of ecological rule of law.A scientific and complete system of ecological rule of law is helpful to realize the formal level and substantial level of rule of law,guaranteeing the construction of ecological civilization through rule of law,and promoting the socialist rule of law system with Chinese characteristics.
