洪江商事习惯法价值简论

On the Value of Commercial Customary law in Qing Dynasty: Take Hongjiang Commercial Customary Law as an Example

湖南洪江千年古商城,有悠久的商业和文化历史,明清时期尤其兴盛,其商事习惯法内容十分丰富,具有清代商事习惯法典范意义。本文根据田野调查获得的资料,对其价值做了初步探讨。洪江商事习惯法的内容在一定程度上反映了传统商事习惯法作为中华法系不可或缺的重要部分。洪江商人创制立规折射出传统商事习惯法的"法治"精神,从而彰显出它的法律价值及其文化意义。

Hongjiang,an ancient commercial city with a long history of commerce and culture,flourished in Ming and Qing Dynasties.The content of Hongjiang commercial customary law is very rich,which is a model of commercial customary law in Qing Dynasty.Based on the data obtained from the field survey,this paper makes a preliminary discussion on the value of Hongjiang commercial customary law.Traditional commercial customary law is an indispensable part of the Chinese legal system.Hongjiang merchants’creation and establishment of rules reflect the spirit of"rule of law"of traditional commercial customary law,thus showing its legal value and cultural significance.
