摘要
歧视性解雇、报复性解雇等恶意解雇行为,不仅侵害劳动者的工作权、人格尊严等合法权利,而且危害社会公共利益。我国司法机关应注重解雇事由的实质审查,加强歧视性解雇、报复性解雇的司法规制。我国立法应拓展禁止解雇的事由,构建惩罚性赔偿制度,减轻劳动者的举证责任,提高歧视性解雇、报复性解雇的违法成本。
Malicious dismissals such as discriminatory dismissal and retaliatory dismissal not only violate the legitimate rights and interests of workers’right to work and human dignity,but also endanger social and public interests.China’s judicial organs should pay attention to the substantive examination of dismissal causes,and strengthen the judicial regulation of discriminatory dismissal and revenge dismissal.The reasons for prohibiting dismissal should be expanded in China.To improve the illegal cost of discriminatory dismissal and retaliatory dismissal,the punitive compensation system should be established,and the burden of proof on workers should be reduced.
