内部事务信息的确立、运用和发展兼论与过程性信息的界分

The Establishment, Use and Development of the Internal Affairs Information Together with Distinguishing from the Process Information

内部事务信息与过程性信息从有"名不正"之嫌到正式列入免除公开事项,源于契合国际惯例和保护行政有效运转利益的考量。然而,大量案例表明,"内部事务"与"过程性"本身指向笼统,涵盖性极广,内部事务信息与过程性信息相互勾连交织,难以有效区分,有必要进行重新界定。内部事务信息应限缩并更名为"纯行政内部信息",主要指技术性、细节性信息,不公开的理由在于与公共利益、特定公民组织利益关系不大。过程性信息应为"机关及其人员的评价性信息",公开将有损于行政内部有效交流和决定质量。

The internal affairs information and process information,developed from the misnomer to formal nondisclosure information,lay in the considerations of consistency with international practice and protection of effective administrative operation.However,a number of cases shows that"internal affairs"and"process"are ambiguous and broad,and that both kinds of information are interwoven and hard to distinguish each other.So it is necessary to redefine them.The internal affairs information should be restricted and renamed to"solely internal affairs information",mainly covering the routine or trivial information that they could not be subject to a genuine and significant public or private interest.Process information should be evaluation information of administrative agency and its employees which disclosure prejudices the free and frank exchange of views for the purposes of deliberation and quality of decisions.
