规制合作的CETA范式:生成逻辑、文本内容与实践进展

The Paradigm of Regulatory Cooperation in CETA: The Generation Logic, the Text and the Practice

随着传统贸易壁垒得到有效控制,边境后措施对国际经贸的影响愈发突显,如何进行规制合作已成为进一步贸易自由化的重要问题。在此方面,作为新时期重要贸易协定的CETA率先形成了规制合作新范式,以作为对当前国家间规制合作需求的回应。CETA下的规制合作在文本内容上完成了换代转变,通过灵活开放的条款设计,在尊重国家规制主权以及条约体系性约束的基础上,尽可能满足经贸活动的规制合作需要。各项具体合作也在以不同于以往的方式有序展开。CETA规制合作实践对形式内容与实质内容同样重视,同时涉及程序内容与实体内容。而且,这些实践总体上尊重文本框架的约束,这在某种程度上也证明了这一规制合作范式的有效性。CETA规制合作范式对国际经贸关系存在潜在影响,我国有必要跟进规制合作问题以进行有效应对。

As traditional trade barriers are effectively controlled,the impact of behind-the-border measures on international trade has become increasingly prominent.How to conduct regulatory cooperation has become an important issue for further trade liberalization.In this regard,CETA,an important trade agreement in the new era,has taken the lead in forming a new paradigm of regulatory cooperation as a response to the current demand for regulatory cooperation among countries.The regulatory cooperation under CETA has completed the evolvement of the text content.Through flexible and open design of clause,it can meet the regulatory cooperation needs of economic and trade activities as much as possible on the basis of respect for the national regulatory sovereignty and treaty system.Specific cooperation is also being carried out in different ways.The practice of regulatory cooperation under CETA attaches equal importance to form and essence,as well as to procedural content and substantive content.In addition,practices generally respect the text,which proves the effectiveness of the regulatory cooperation.The paradigm of regulatory cooperation in CETA has potential impacts on international economic and trade relations.It is necessary for China to follow up on regulatory cooperation issues for effective responses.
