论土地经营权的法律性质和赋权逻辑——以土地流转影响因素为视角

Legal Nature and Empowerment Logic of Land Management Right:From the perspective of influencing factors of land circulation

"三权分置"改革的核心在于对土地经营权法律性质的认定和对土地经营权制度的完善。通过对河北省X县土地流转影响因素的实证分析,可以发现明确土地经营权的性质、维护土地交易的安全与稳定,是促进农地规范有序流转的核心要素。对土地经营权性质的界定,既要在理论上具有法理基础,也要切实考虑不同农户的利益诉求,从而构建最佳化的土地经营权权利结构。理论和实践证明,土地经营权的物债二分权利构造,有利于实现"放活经营权"的政策目标和"三权分置"改革的价值追求,是解决我国人地矛盾的不二选择。

The key to the reform of"The Separation of Three Rights"(land ownership,contract right and management right)lies in recognizing the legal nature of the land management right and improving the land management right system.Through the empirical analysis of the influencing factors of land circulation in X County,Hebei Province,it can be found that clarifying the nature of land management rights and maintaining the security and stability of land transactions are the key factors to promote the standardized and orderly circulation of rural land.The definition of the nature of land management right should not only have legal basis in theory,but also take into account the interests of different farmers,in order to build an optimal structure of land management right to promote the transfer of agricultural land.Theory and practice have proved that the dual right structure of land management right is conducive to realize the policy goal of"releasing the management right"and the value pursuit of the reform of"The Separation of Three Rights",which is the only choice to solve the common contradiction between man and land in our country.
