全球公域可以进行分割吗?尽管从实践上来看,分割似乎是显而易见的,然而,一旦深究“全球公域”这一概念的内涵,上述事实便悄然隐去。全球公域的开放似乎才是理所当然的。在一开始,全球公域处在自由开放的状态,但随着人类的逐渐介入,主权引入全球公域成为必然趋势。由于全球公域不再难以占有和控制,资源非竞争性的特征也终究难以为继,且来自全球公域的威胁逐渐成为各国的普遍关注,因此,主权原则可以、必须且应当介入全球公域。然而,这并不意味着要将全球公域“划国而治”,尤其是从全球公域空间的角度来说,在一个全球化的时代,全球公域的开放对各国经济发展和人类交往至关重要。所以,多数国家不会拒斥全球公域的开放,但其前提是能够确保国家的安全。

Can the global commons be divided?Such a division seems obvious in practice,but as far as the concept of"global commons"is concerned,it is the openness while not the divisibility that should be taken for granted,which tells the global commons could be free and open at a kind of original position.However,sovereignty would be inevitable to be introduced into the global commons when mankind gradually gets involved,which makes the global commons hard to be non-rivalrous but easy to be occupied and controlled,and threats at the meanwhile from the global commons have gradually attracted universal attention from all nation-states.Although the principle of sovereignty could,must and should get involved with global commons,it does not mean that they should be divided up according to the borderlines.Seeing global commons as a kind of space,in the era of globalization,the openness is of great importance for the economic development and communication in and among different countries.Therefore,most countries will not refuse the openness of the global commons as long as their national security is guaranteed.
