论民间规范与地方立法的良性互动

On the Positive Interaction between Folk Norms and Local Legislation

作为一种在民间社会自发生成的规范体系,民间规范对于社会关系的调整具有独特优势。充分发挥民间规范在社会治理领域的作用,必须处理好民间规范与国家立法之间的关系。具体到地方社会治理层面,即是要实现民间规范与地方立法的良性互动。这种良性互动既是对法治中国"三位一体"建设的必要回应,也是民间规范与地方立法发展的内生需求,并具备现实可能性。然而,民间规范与地方立法的良性互动仍面临"国家法中心主义"观念的阻碍,并受制于两者冲突的存在及交互的缺失。为此,有必要在引入"规范多元化"理念的基础上,对民间规范与地方立法的冲突予以调适,并通过促进民间规范与地方立法的交融,以实现民间规范与地方立法的良性互动。

As a regulation system generated by the folk society,folk norms has a unique strength toward the adjustment of the social relationship.Folk norms play an vital role in the social governance.In order to take full advantage of them,we carefully handle the relationship between folk norms and national legislation.Specifically,in terms of the local governance,we need a positive interaction between folk norms and local legislation.This positive interaction is a necessary response to the development of the"trinity"of the rule of law of China.It is also an inner demand for the development of folk norms and local legislation,which makes it possible to achieve.However,the positive interaction between folk norms and local legislation still faces an obstacle,which is the concept of national law centrism.It as well subjects to their conflicts and their lack of interaction.Therefore,it is imperative that we should introduce the concept of diverse regulations to coordinate the conflicts between folk norms and local legislation.Besides,we need to encourage the interactionbetween them to reach the goal of the positive interaction between folk norms and local legislation.
