数字贸易中的知识产权议题

随着国际贸易便利化和数字产品大众化的推进,国际贸易中的数字化趋势不可避免。数字贸易超越了电子商务的狭隘界定,改变了国际贸易的方式和对象。知识产权议题在数字贸易中发挥更加重要的推动作用,数字盗版、平台责任过重和知识产权执法不力将成为数字贸易的真正壁垒。面对数字产品界定、源代码与算法保护、数据权益和平台责任等数字贸易知识产权议题的新发展,中国应当在贸易规则和知识产权规则两方面都有所准备,在立法层面充分利用知识产权的限制和例外制度,在执法层面关注海关执法和新技术的应用,提前应对数字贸易的区域主义和贸易保护措施。

With the promotion of international trade facilitation and digital products popularization,the trend of international trade digitalization is inevitable.Digital trade goes beyond the narrow definition of e-commerce,and changes the way and the object of international trade.Intellectual property protection plays a more important role in promoting digital trade.At the same time,lack of intellectual property protection and weak law enforcement will become the real barrier to digital trade.Faced with the new development of intellectual property protection rules in digital trade,China should be prepared for both trade rules and intellectual property rules,and deal with regionalism and trade protection measures of digital trade at the legislative and law enforcement levels.
