论支持起诉时检察机关诉讼地位的选择——从民事公益诉讼切入

On the Choice of Litigation Status of Procuratorial Organs in Supporting Litigations From Civil Public Interest Litigation

公益诉讼的兴起激活了支持起诉原则,但是各地检察机关却在实践中遭遇诸多程序上的困境。争议的产生与检察机关在支持起诉时诉讼地位不明密切相关。检察机关以出席庭审的方式支持起诉时讨论其诉讼地位的前提。但是诉讼参加人视角下的检察机关定位与其权能存在一定的矛盾;而从诉讼参与人视角下进行讨论较为妥当。支持起诉人作为一种全新的诉讼参加人更能符合检察机关在公益诉讼中的角色定位。

The rise of public interest litigation has activated the principle of supporting prosecution,but the procuratorial organs in various places have encountered with many procedural difficulties in practice.The emergence of disputes is closely related to the unclear status of prosecution in supporting prosecution.Attendance at the hearing is the premise of discussing the litigation status of procuratorial organs.However,there is some contradiction between the position of the procuratorial organ and its power from the perspective of the litigant participants that can start litigations,and it is more appropriate to discuss it from the perspective of the litigant participants that can only take part in a litigation.The latter is a new type of litigation participants that can be more in line with the role of procuratorial organs when they support civil public interest litigations.
