现代学徒制背景下学徒权益现状及法律保障研究

Study on the Status Quo of Apprentice’s Rights and Interests and Legal Protection under the Background of Modern Apprenticeship

目前,国内现代学徒制还处于探索阶段但即将全面推行,相关现代学徒制的部分概念依然缺乏共识,学徒权益受损的情况时有发生,主要表现在学徒的受教育权、劳动权益、人身权益以及财产权益被侵害。通过完善现代学徒制法律法规体系、明确学徒合法权益保障主体、规范学徒合法权益保障程序、加强学徒的法治教育等途径,将学徒权益保护纳入法治化轨道,从法律层面构建起学徒权益的保障机制,最终驱动现代学徒制的全面推行以及职业教育的可持续发展。

At present, domestic modern apprenticeship is still in the exploration stage, but is about to be fully implemented. There is still no consensus on some concepts of modern apprenticeship. The apprentice’s right to education, labor rights, personal rights, and property rights are violated. Through the improvement of modern apprenticeship laws and regulations, clarifying the subject of apprentices’ legal rights and interests’ protection, standardizing the procedures for regulating the legal rights and interests of apprentices, and strengthening the rule of law education for apprentices. It is suggested to incorporate the protection of apprentice rights into the rule of law, establish the apprenticeship rights protection mechanism from the legal level. Through these channels, it will ultimately drive the full implementation of modern apprenticeship and the sustainable development of vocational education.
