随着乡土精英权威的下降以及法治进程的推进,越来越多风水纠纷诉至法院寻求权威救济。生效司法裁判文书表明风水纠纷的司法裁判缺乏统一标准,造成了司法裁判风水纠纷时存在不正当回避、同案不同判现象明显、说理不充分等问题。应当将民俗习惯作为破解风水纠纷司法裁判困境的重要规则,通过规范证明和识别程序,强调注重裁判说理等方式优化风水纠纷的裁判路径。

As the authority of local elites declines and the rule of law advances,more and more geomantic omen disputes are brought to court for authoritative relief.It is shown by the effective judicial judgment documents that there is no uniform standard in the judicial judgment of geomantic omen disputes,which leads to some problems such as improper avoidance,obvious phenomenon of different judgments in the same case,insufficient reasoning and so on.Folk customs should be regarded as an important rule to solve the dilemma of judicial adjudication of geomantic omen disputes,and the adjudication path of geomantic omen disputes should be optimized by standardizing the procedures of proof and identification and emphasizing the reasoning of referees.
