新型农村社区纠纷解决中的民间法适用:问题与路径

The application of folk law in the settlement of disputes in new rural communities:Problems and paths

城乡统筹与融合的兴起,势必对新型农村社区治理秩序产生影响。民间法作为一种内生性的秩序规范,为其注入契合转型的法治价值,成为社区控制机理的关键。通过对新型农村社区案例进行考察,发现传统农村基层治理在迈向新型农村社区治理秩序转型过程中面临无序风险,呈现出社区自治与民间法适用的“合谋”、基层司法机关适用民间法困难、“小事件”在治理过程中调适的困惑、传统与现代规范适用冲突等多重困境。为此,应当立足于新型农村社区治理的实际,建立起民间法与成文法适用的识别机制,通过“自治传统、社区体制与居民”三方协同联动,将“小事件治理”融入新型农村社区治理,加强成文法对民间法自发性的规范指引,从而优化民间法在治理新型农村社区过程中的运行环境,并推动实现乡村振兴。

With the rise of Urban-Rural Coordination and integration,it is bound to change the new rural community governance order.As an endogenous order norm,folk law injects the value of the rule of law that fits the transformation and becomes the key to the community control mechanism.Through the case study of the new rural community,it is found that the traditional rural grass-roots governance is facing the risk of disorder in the process of transition to the new rural community governance order,showing multiple dilemmas such as the“conspiracy”between community autonomy and the application of folk law,the difficulties in the application of folk law by the grass-roots judicial organs,the confusion in the adjustment of the“small event”governance path,and the conflict in the application of traditional and modern norms.This requires that we should start from the reality of the new rural community governance,we will make breakthroughs in specific ways such as striving to shape the identification mechanism for the application of folk law and written law,and integrating“small event management”into the new rural community governance,through the tripartite coordination mechanism of“autonomy tradition,community system and residents”,Strengthening the principle of written law and guiding the spontaneous regulation of folk law.And then optimize the operation environment of folk law in the process of governance of new rural communities,At the same time,it has special practical significance to help realize the goal of Rural Revitalization.
