人民法院构建涉侨矛盾纠纷调处化解共同体的“青田模式”研究

“青田模式”由人民法院牵头,侨联协调,国内和海外涉侨组织、其他机关、单位和组织参与,并形成涉侨矛盾纠纷调处化解共同体。以海外涉侨组织为主体,以国内涉侨组织为纽带,以“一法官一侨团”为联系机制,发挥公证、金融机构等的协同作用。“青田模式”坚持新时代“枫桥经验”以人民为中心的基本理念,适应新时代主要矛盾的变化,夯实涉侨统一战线的群众基础,增强华侨社群应对风险的韧性。坚持并发展“枫桥经验”就地化解矛盾的基本做法,将“地”延伸到海外。充分发挥华侨、涉侨组织、侨领的积极性、创造性,体现自治的基础作用。强调人民法院的职权功能,保证涉侨组织、侨领参与涉侨矛盾纠纷化解的规范性和有效性,体现法治的保障作用。通过凝聚血浓于水的中华民族心理认同,发挥侨乡的文化的治理,促进华侨群体互助、互信等公序良俗的形成,体现德治的教化作用。

The"Qingtian model"is led by the people’s court,coordinated by the Federation of overseas Chinese,with the participation of domestic and overseas overseas overseas Chinese related organizations and other organs,units and organizations,and forms a community for mediating and resolving overseas Chinese related contradictions and disputes.Take overseas Chinese related organizations as the main body,domestic overseas Chinese related organizations as the link,and"one judge and one overseas Chinese group"as the contact mechanism to give play to the synergy of notarization and financial institutions."Qingtian model"adheres to the basic concept of people-centered"Fengqiao Experience"in the new era,adapts to the changes of the main contradictions in the new era,consolidates the mass foundation of the overseas Chinese related united front,and enhances the resilience of the overseas Chinese community to deal with risks.Adhere to and develop the basic practice of"Fengqiao Experience"to resolve contradictions locally,and extend the"land"to overseas.Give full play to the enthusiasm and creativity of overseas Chinese,overseas related organizations and overseas Chinese leaders,and embody the basic role of autonomy.Emphasize the functions and powers of the people’s court,ensure the standardization and effectiveness of the participation of overseas Chinese related organizations and overseas Chinese leaders in the resolution of overseas Chinese related contradictions and disputes,and reflect the guarantee role of the rule of law.By condensing the psychological identity of the Chinese nation that blood is thicker than water,give play to the cultural governance of the hometown of overseas Chinese,promote the formation of public order and good customs such as mutual assistance and mutual trust among overseas Chinese groups,and reflect the educational role of rule of virtue.
