大陆法系国家地方立法与民间规范关系考察研究——以德国、比利时、日本为例

Research on the Relation between Local Legislation and Folk Norms in the Countries of Continental Legal System Taking Germany,Belgium and Japan as Examples

地方立法与民间规范的结合体现在大陆法系国家法治建设的诸多方面,对我国法治建设具有借鉴意义。通过对德国互联网地方立法与民间规范融合发展实践、比利时城市文化保护地方立法与民间规范的融合发展实践、日本城乡社区治理地方立法与民间规范的融合发展实践的考察,总结、归纳其中合理的部分,可以为我国地方立法和民间规范的良性互动、融合发展提供有益的启示和借鉴。

The combination of local legislation and folk norms has been revealed in various aspects of social life in continental legal system,which is valuable for the construction of the rule of law in China.The authors have respectively examined the practice of integrative developments on Internet local legislation and folk norms in Germany,the practice of integrative developments on urban cultural protective local legislation and folk norms in Belgium,and the practice of integrative developments on Urban and rural community governmental local legislation and folk norms in Japan.According to the analyses and summaries of these countries’practices,this article further provided suggestions on how China facilitates the benign interaction and integrative developments between local legislation and folk norms.
