论法律渊源与法律之间的结构性关联

On the Structural Connection Between the Source of Law and the Law

“法律渊源是否法律”是个重要的法理论问题,然而当前作为问题的法律渊源并没有得到学者的充分重视。仅从语词上分析,“法律渊源”即便不是法律,也必然与法律存在着某种关联,而将所有的法律渊源视为法律则忽视了现实中法律渊源概念存在和运作的复杂性。作为一项以渊源为本位的事业,法律对自身界限问题有着自我规定性,法律的这种自我规定性为探究法律渊源与法律关系之间复杂结构性关联方式提供了切入点,其中可以发现法律渊源与法律既存在着区分上关联,也存在着品质性关联。有些法律渊源是法律,有些渊源不仅是法律,更表征着法律的品质。

"Is legal source the law"is a important issue of legal theory,however current scholars have paid little attention to a subtle distinction between legal source and the law,ignoring the issue of legal source.Only from the perspective of lexical analysis,"legal source"is bound to have some relationship with law,even if it is not the law itself,while to regard all legal origins as the law itself ignores legal source’s complex existence and operation in reality.Law is a source-based enterprise,and understanding its nature accordingly requires understanding which sources constitute the law and which do not,and law’boundary is handled by the self-creation of law,which provides a starting point to explore the complex structural relationship between source of law and the law.Two different kinds of associations should be in mind,namely differentiated association and quality association.Some sources of law are law,and some sources are not only law,but also reflect the quality of law.
