摘要
员额动态管理制度是司法责任制综合配套改革的重要内容。在各级法院检察院员额遴选到位,员额制改革成效初显的当下,员额动态管理却仍处于模糊状态,对员额动态管理制度的基本内涵、目标功能认识不清,具体实施很不到位。为此,有必要清晰界定员额动态管理制度的内涵、目标及功能,澄清认识误区,明确员额动态管理制度的构建逻辑。在具体实施中,应注重从员额职责界定、员额业绩考核和员额退出等主要方面予以完善优化、协同配合、同步推进。
The post dynamic management system is an important part of the comprehensive reform of the judicial responsibility system.Although the selection of posts for courts and procuratorates at all levels are in place,and the post system reform has achieved initial results,the dynamic management of posts is still in a state of vagueness.The basic connotation and objective functions of the post dynamic management system are still unclear,and the specific implementation is not in place.So,it is necessary to clearly define the connotation,objectives and functions of the post dynamic management system,clarify the misunderstandings,and clarify the construction logic of the post dynamic management system.In the specific implementation,attention should be paid to the main aspects such as the definition of post responsibilities,post performance evaluation and post withdrawal,etc.we should improve and optimize the post dynamic management,coordinate and advance simultaneously.
