众包型纠纷解决中的民间规范及其运作机制分析——以淘宝大众评审制为例

网络经济的快速发展衍生了大量的线上交易纠纷,而这威胁着互联网经济的进一步繁荣。面对实体交易纠纷向虚拟线上纠纷的转型,现有纠纷解决机制无法满足公众对纠纷解决的需求,由此众包型纠纷解决——大众评审制应运而生。大众评审制的产生是第三方平台、平台商家和消费者三方博弈的结果,其通过裁定规则对交易纠纷进行处理,通过滞付机制保证判定的执行,用信用公示维护执行的效果,施以流量利益消除裁定产生的不公。众包型纠纷解决所适用的民间规范与现行立法、司法体制相互影响,互为补充,实现了公众对纠纷解决效率与公平正义价值的追求。

the rapid development of network economy leads to a large number of online transaction disputes,which threaten the further prosperity of Internet economy.In the face of the transformation from entity transaction disputes to virtual online disputes,the existing dispute resolution mechanism cannot meet the needs of the public for dispute resolution,so the crowdsourcing dispute resolution public review system emerges as the times require.The emergence of the public review system is the result of the game among the third party platform,platform merchants and consumers.It deals with the transaction disputes through the ruling rules,guarantees the execution of the judgment through the mechanism of delayed payment,maintains the effect of the implementation with the credit publicity,and eliminates the unfairness of the ruling by imposing flow benefits.The folk norms applicable to crowdsourcing dispute resolution interact with the current legislation and judicial system,and complement each other,realizing the public’s pursuit of the efficiency of dispute resolution and the value of fairness and justice.
