通过法律与情理的社会控制——以南宋“名公”淫祠邪祀治理为视角的分析

摘要 传统中国的社会控制模式有别于近现代西方通过法律的社会控制模式,这在南宋“名公”们治理淫祠邪祀的判书中得到了体现。从《名公书判清明集》记载的13件司法官员治理淫祠邪祀的判书中,可以得知当时南宋的淫祠邪祀泛滥带来了一系列社会危害,破坏了地方风俗。儒学出身的司法官员们总是背负着教化社会的使命,移风易俗就是社会教化的重要环节,治理淫祠邪祀以“美风俗”成了司法官员们使命性的责任。而儒家“德治”“劝喻”式的教化理念也决定了他们轻视唯法是用的社会控制模式,在适用法律的基础上大量使用“情”与“理”是普遍的做法。 The traditional Chinese way of social control is different from the modern western way of social control by law,which is reflected in the judgment book of"ming gong"in the Southern Song Dynasty on the regulation of prostitution,worship and worship.It can be seen from the records of 13 judicial officials’judgments on the worship of prostitution in the Qingming Dynasty that the epidemic of prostitution in the Southern Song Dynasty brought about a series of social harms and destroyed the local customs.The judicial officials from The Background of Confucianism always bear the mission of educating the society,and changing customs is an important link of social education.It has become the mission responsibility of judicial officials to control prostitution,worship and"beautiful customs".The Confucian educational concept of"rule by virtue"and"persuasion"also determined that they despised the social control mode based on the only law,and it was a common practice to make extensive use of"sentiment"and"reason"on the basis of the application of law.
