From Dispersion to Unity——On the Legislative Chaos of Local Rights Vacation and the Ways to Overcome

近年来,地方权益性假期引起公共传媒的密切关注。地方权益性假期在立法上表现出突出权利保护、配套措施缺位、欠缺保障手段、横向口径不一等四大特征,同时也暴露出合法性存疑与实操性不足这两个主要问题。地方权益性假期的出现实质上是地方立法机关在制造权利,不审慎的权利设定不仅不会实现立法目的,反倒有可能激化权利冲突,加剧国家与社会之间的摩擦。地方权益性假期意图保护的各项权益完全能够在现行假期制度框架内加以实现,应在着力完善已有假期制度的基础上保障劳动者真实地享有休息休假的权利,而不是不断推出一个又一个难以兑现的“画饼”式假期。

In recent years,local rights vacation have attracted close attention from the public media.In the legislation of local rights vacation,it has emerged four characteristics:prominent rights protection,the absence of supporting measures,lack of guarantee means and disunited horizontal caliber.It also exposes doubtful legality and lack of practical operation these two main problems.In fact,the emergence of local rights vacation is the creation of local legislatures.The imprudent setting of rights will not achieve the legislative purpose,but may intensify the conflict of rights and the friction between the state and the society.The rights and interests which local rights vacation intended to protect can be fully achieved in the frame of present vacation system.It should focus on modifying the existing vacation system to make sure that most labors may have the real right to rest and vacation,truly not roll out one after another empty promises.
