社区网格化治理法治化的规范之维——基于社会内在性视域

The Normative Dimension of Community Grid Governance Rule by Law——Based on the SocialInternality Perspective

网格化治理是促使社区转变为社会治理共同体的关键。社区网格化治理亟待法治化转型,这是法治社会建设寻求变革的突破口,也是实现国家治理体系和能力现代化的有效路径。在治理规范层面,治理规范的制定和实施过程没有认真对待其社会内在性,公众参与度低,大多数社会主体对于网格化治理规范的社会内在性认知缺失,严重制约了治理规范的法治化转型。立足于社会本位,利用社会内在性理论对社区网格化治理规范进行分析,有助于我们在明确其应然状态的同时,揭示其现实困境。基于社会内在性视域,治理规范的法治化应当进一步优化,具体可从四条路径予以实现。一是构建和完善保有社会内在性的多元治理规范体系;二是强化和优化基于社会内在性的政府执法机制;三是强化和优化基于社会内在性的社区普法机制;四是强化和优化基于社会内在性的守法用法机制。

Grid governance is the key to transform community into social governance community.Community grid governance needs to be transformed by law,which is the breakthrough to seek change in the construction of legal society,and also an effective way to realize the modernization of national governance system and ability.At the level of governance norms,the process of making and implementing governance norms does not take their social internality seriously,public participation is low,and most social subjects lack the social intrinsic cognition of grid governance norms.Seriously restricted the governance norms of the transformation of the rule of law.Based on the social standard,using the theory of social internality to analyze the norms of community grid governance is helpful.At the same time,we reveal its realistic predicament.Based on the social internality perspective,the rule of law of governance norms should be further optimized,which can be realized from four paths.The first is to construct and perfect the pluralistic governance standard system which maintains the social internality;the second is to strengthen and optimize the government law enforcement mechanism based on the social internality;and the third is to strengthen and optimize the community law popularization mechanism based on the social internality.
