德昂族习惯规范研究的回眸与前瞻

Review and prospect on the study of De’ang Ethnic Group’s customary norm

德昂族是一个历史悠久的古老民族,德昂族习惯规范及其纠纷解决机制至今依然熠熠生辉。研究德昂族习惯规范及其纠纷解决机制,必须了解与之相关的论著,尤其需关注习惯规范相关理论研究方面的成果,因为仅仅注重经验研究难免失之于肤浅,设法实现从经验到理论的跨越才是学术研究的永恒追求。德昂族习惯规范的研究成果尚不系统,且多留在描述层次,缺乏细致深入的文化阐释与法理分析。未来德昂族习惯规范的研究应运用多学科的研究方法,注重场景深描和深度解析,致力于发现德昂族习惯规范与当今法人类学理论的背离之处,然后对之进行深入思考并合理阐释,力争为我国民族法理论的提升增砖加瓦。

Deang ethnic group is an ancient ethnic group with a long history.Its custom norms and dispute resolution mechanism are still shining up to now.In order to study Deang’s customary norms and dispute settlement mechanism,we must understand the relevant works.Especially,we should pay attention to the relevant theoretical research results of customary norms,because it will inevitably be superficial only focusing on empirical research.Trying to realize the leap from experience to theory is the eternal pursuit of academic research.The research results of Deang’s customary norms are not systematic,and most of them remain at the level of description,which lack detailed and in-depth cultural interpretation and legal analysis.In the future,the study of Deang’s customary norms should adopt a multi-disciplinary research method,pay attention to the deep description and deep analysis of the scene,and try to find the deviation between De’ang customary norms and the theory of legal anthropology.Then,the Scholars should think deeply and explains it reasonably to improve the theory of national law in our country.
