民间规范价值再证——历史视角的考察

民间规范研究虽然在不断发展,但是研究者们关注的焦点始终是民间规范规则本身,而往往忽视了民间规范价值。民间规范价值是民间规范研究的重要内容,从历史角度分析,可以进一步证明民间规范价值存在的事实,进而为民间规范价值融入国家法治建设事业奠定理论基础。从立法历史角度看,各个历史时期的立法都吸收了民间规范价值,以此来实现立法合理性,促进立法有效实施。从司法历史角度看,无论是英美法系还是大陆法系,司法实践的发展历程中都融合了民间规范价值的内容,来体现司法正义,保障司法公正。因此,民间规范价值研究必须获得重视,通过民间规范价值促进民间规范研究的理论提升,为国家法治建设提供理论资源。

The folk norm value is an important part of the study of folk norms.From a historical point of view,it can prove the fact that the value of folk norms exists,and lay a theoretical foundation for the integration of the folk norm value into the cause of national rule of law.From the perspective of legislative history,the legislation of each historical period has absorbed the value of folk norms,so as to realize the legislature rationality and promote the effective implementation of legislation.From the perspective of judicial history,whether in Anglo-American law system or continental law system,the development process of judicial practice has integrated the content of folk normative value to reflect judicial justice and ensure judicial justice.Therefore,the research on the value of folk norms must be paid attention to,and promote the theoretical upgrading of the research on folk norms through the value of folk norms,so as to provide domestic resources for the improvement of the connotation of the value of national rule of law.
