我国涉外法治人才培养的现实困境与优化建议

Practical Dilemma and Optimization Suggestions on the Training of Foreign-related Legal Talents in China

受全球化浪潮的影响,法学教育的国际化趋势已成为当前教育模式下的主流观念。目前,我国涉外法治人才培养模式仍处于尝试、探索阶段,尽管在已有的尝试中取得了丰硕成果,但距离涉外法治人才培养模式的最终面向还存在一定差距。通过对各国法治人才培养方式的考察,能够为我国涉外法治人才培养模式的建立提供有益经验。我国涉外法治人才培养模式的确立应完成素质教育向精英化教育模式的转变,将国际法学上升到法学一级学科的地位,设计科学合理的教学课程体系,坚持涉外法治人才培养模式的本土面向。

Influenced by the tide of globalization,the internationalization trend of legal education has become the mainstream concept under the current education model.At present,China’s foreign-related legal talents training pattern is still in the stage of trial and exploration.Although fruitful results have been achieved in the existing attempts,there is still a certain gap from the final orientation of the foreign-related legal talents training pattern.Through the investigation of the training patterns of legal talents in various countries,it can provide beneficial experience for the establishment of legal talents training pattern concerning foreign affairs in China.The establishment of legal talents training pattern concerning foreign affairs in China should complete the transformation from quality-oriented education to elite education pattern,elevate international law to the status of first-level discipline of law,design scientific and reasonable teaching curriculum system,and adhere to the local orientation of legal talents training pattern concerning foreign affairs.
