人类命运共同体与新时代的中国法学

The community of human destiny and the Chinese law in the new era

人类命运共同体,植根于中国传统法律文化资源,与国际社会谋和平、求发展、促合作的共同愿望具有相同的价值目标,成为当下国际社会新秩序构建的话语体系。哲学、政治学领域等相关学科对人类命运共同体展开了广泛的研究,但是法学研究相对滞后。人类命运共同体可以也应当成为法学研究的新命题,从法学,尤其是法理学视角反思人类命运共同体的构建,是法理学研究者的时代使命。法学研究者不仅应当阐释人类命运共同体的法理意蕴,而且应当从法律的视角提出构建人类文明共同体的制度架构。

The human destiny community,rooted in the traditional Chinese legal cultural resources.It has the same value goal with the international community for the common desire for peace,development and cooperation.And it has become a discourse system for the construction of the new order of the international society.Philosophy,politics and other related disciplines have extensively studied the fate community of human beings.But the study of the human destiny community in law is lagging behind.The community of human destiny should also be a new proposition of the study of law.It is the mission of the researchers of jurisprudence to reflect on the construction of the community of human fate from the perspective of law,especially in the jurisprudence.The legal researchers should not only explain the jurisprudential meaning of the human destiny community,but also put forward the institutional framework of the construction of the human civilization community from the perspective of law.
