新时代背景下人民调解制度的研究——以深圳为例

The Perfection of People’s Mediation System in the New Times——Take Shenzhen as an Example

人民调解是以我国民间调解的优良传统为基石发展起来的解决社会纠纷的机制,在改革开放40年的新时代背景下,为了缓解人民法院过度的办案压力,同时高效解决当前社会多元化的矛盾纠纷,深圳市积极推动人民调解成为解决社会矛盾纠纷的重要机制,也取得了一定的进展与成就。通过实地调研深圳市12家参与人民调解的机构,笔者深入了解了深圳市人民调解的工作现状和运行模式,并对以上机构的组织机构、人员和经费安排、工作经验以及存在的问题这四个方面进行了归纳总结,同时进一步对深圳市人民调解制度存在的问题进行分析,最后立足于人民调解与司法、仲裁相结合的深圳实践模式,提出了进一步完善我国人民调解制度的建议。

People’s mediation is a mechanism to solve social disputes that is based on the fine tradition of folk mediation in our country.In the new era of 40 years of reform and opening up,in order to ease the excessive pressure of the people’s courts in handling cases,and at the same time effectively to solve the current social multiple contradictions,Shenzhen actively promoted people’s mediation as an important mechanism to resolve social contradictions and disputes,and also have made certain progress and achievements.Through on-the-spot investigations into the12 agencies involved in people’s mediation in Shenzhen,the author has gained insights into the working conditions and operating models of Shenzhen’s people’s mediation,and summarized the four aspects of the organization,personnel and funding arrangements,work experience and existing problems of the above institutions,and further analyzed the problems existing in the people’s mediation system of Shenzhen.Basing on the Shenzhen practice model of combining people’s mediation with litigation or arbitration,then put forward suggestions for further improving people’s mediation system in our country.
