摘要
现代大学法治化治理是深化依法治国实践的重要体现,同时是完善中国特色现代大学制度的内在要求。大学法治化治理中自由与秩序平衡具备内在的逻辑。秩序的"向自由性"与自由的"合秩序性"构成了二者平衡的机理;同时自由与秩序具备共生的社会性基础。自由与秩序依靠自动调节和制度调节方式运行。现代大学法治化治理中自由与秩序的平衡要彰显学术本质,回归现代大学治理的自由之魂;依法自主办学,夯实现代大学治理的秩序之根;实行民主管理,坚守现代大学治理法治化之本。
The law-based governance of modern universities is an important embodiment of deepening the practice of ruling the country by law,and also an internal requirement of improving the modern university system with chinese characteristics.Freedom and order have inherent logic in the rule of law in universities.The mechanism of balance between order’s"towards freedom"and freedom’s"conformity to order"is formed,and freedom and order have the social basis of symbiosis.Freedom and order depend on automatic regulation and institutional regulation.The balance between freedom and order in the rule of law in modern universities should highlight the academic essence and return to the free soul of modern university governance;run schools independently according to law and consolidate the root of order of modern universities management;conduct democratic management and adhere to the rule of law in modern universities governance.
